Pensacola, FL (Newsradio 92.3) --The mother that was charged as an accomplice after her son shot and killed a woman in a local Home Depot store will have video evidence in her case thrown out. Sheila Agee was in court yesterday. Her attorneys filed a motion to dismiss video of her attending a balloon release for the victim Brooklyn Sims, as well as police bodycam video. The state agreed to toss the video evidence -- but said it could be used at sentencing if she's convicted. Another motion to toss a series of text messages was denied. Prosecutors say Agee encouraged and helped her son Keith Agee murder Sims back in August of last year. He's currently serving a life sentence in prison after being found guilty of first-degree premeditated murder last December.
