The parent company of the Pensacola News Journal has filed a motion to dismiss a lawsuit that was filed in connection to Escambia County Commissioner Jeff Bergosh's text messages. Tampa-based law firm Thomas and LoCicero filed the motion yesterday on behalf of Gannett Media, saying in part the complaint is an attempt to "make an end run around the First Amendment protections afforded PNJ by seeking to claw back copies of records, including public records, PNJ lawfully obtained". They add that the lawsuit is an effort to gag further news reporting on the contents of the records. Commissioner Jeff Bergosh alleges that the text messages were stolen, and the county named the PNJ, Jonathan Owens, and another private citizen in their lawsuit.
