Pensacola, FL (Newsradio 92.3) -- More than three months after former Escambia County Deputy Greg Nesmith struck and killed two 20-year-old friends on Perdido Key, the father of one victim is still looking for answers. Victim Les Cunningham is the father of Jackson Cunningham -- he and Nicole Moore were killed while crossing Perdido Key Drive. Both were visiting for the 4th of July weekend. The PNJ reports that Cunningham has filed a lawsuit alleging Nesmith's negligence caused his son's wrongful death. Nesmith claims immunity due to being on duty, the judge denied his motion to dismiss the lawsuit. The investigation remains open, with FHP indicating it could take up to nine months to complete. Nesmith resigned shortly after the incident, and the Escambia Sheriff's Office is conducting an internal investigation, pending the results of the criminal inquiry.
