Defense seeks to toss evidence in Nesmith vehicular homicide case

Attorneys for Greg Nesmith, a former Escambia County Sheriff's deputy facing vehicular homicide charges in the deaths of two 20-year-olds on Perdido Key, are asking a judge to invalidate his arrest warrant and suppress evidence they say was gathered through a misleading investigation, according to court filings.

The legal challenge represents a significant procedural hurdle in the case against Nesmith. Defense lawyers have argued that the investigative process that led to his arrest contained improper conduct, potentially undermining the reliability of evidence prosecutors plan to use at trial.

Nesmith is accused in connection with a fatal crash on Perdido Key that claimed the lives of two young adults. The case has drawn attention given Nesmith's background in law enforcement. A hearing on the defense motion has not yet been scheduled in Escambia County courts.
