Okaloosa County, FL (Newsradio 92.3) -- Attorneys for convicted killer Jeffrey Hutchinson are appealing to the U.S. and Florida Supreme Courts to stop his execution scheduled for Thursday, arguing that his cognitive impairments from military service make him mentally incompetent.
They claim executing him would violate the Eighth Amendment's ban on cruel and unusual punishment, but the state contends he has not proven his insanity. If carried out, Hutchinson's execution will mark the fourth in Florida this year.
Hutchinson is convicted of killing his girlfriend and her three children in Okaloosa County back in 1998.
