Escambia County Commissioner Jeff Bergosh has been dealt a blow in his legal fight to retrieve thousands of text messages that he alleges were stolen. Bergosh and Escambia County had sued the PNJ, Jonathan Owens, and Alex Arduini, requesting a "writ of replevin" ---In layman's terms, they sought the judge to order them to return the text messages. However, Okaloosa County Judge Jonathan Schlechter denied the request, saying in a preliminary ruling "no evidence was presented that indicated any physical media at issue in this matter was the property of Escambia County". Schlechter also says that while the PNJ has possession of the download, no evidence was introduced that they engaged in illicit or illegal conduct to obtain possession. It's important to note that this is only the first step of the lawsuit.
