FLORIDA BILL WOULD PROHIBIT DISCRIMINATION ON THE BASIS OF HEIGHT AND WEIGHT

Andrew McKay 11/01/19

You know those signs that say, “We reserve the right to refuse service to anyone?”  Well, in Florida (and most places in the United States), that’s not actually true.  There are many reasons a hotel or restaurant cannot turn you away from service.  In Florida, Statute already prohibits discrimination against on the basis of race, creed, color, sex, pregnancy, physical disability, or national origin.  Now, a Bill filed by Miami Democrat Senator Oscar Branyon would add “height, weight” to that list.  This would mean hotels and restaurants would have to serve you and employers would have to hire you without regard to your height or weight unless there are “bona fide occupational qualifications (BFOQ) that would relate to these characteristics.
